Prices

All fees and prices are in UAE Dirhams (AED).

Changing of Prices

Merwstore.com prices are subject to modification at any time. Prices may also vary due to a launch price, promotional offer or sale.

Prices of items that are not in stock or are available for pre-order are valid during their promotional period after the order is placed. Should the price change from the pre-order price, the customer will be informed and given the option to cancel the order.

We reserve the right to update prices displayed on the Website from time to time. Once updated, these prices cannot be claimed against an order that has already been confirmed or delivered.

Typographical Errors

Merwstore.com strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links and other product-related information contained on or referenced by our Website.

Due to human error and other factors, we cannot guarantee that all such information is entirely accurate, complete or current, nor can we assume responsibility for these errors.

If a product listed on our Website has an incorrect price due to a typographical, informational, technical or other error, Awok.com shall, at its sole discretion, have the right to refuse or cancel any order for that product and immediately amend, correct or remove the inaccurate information.

Placing an Order

We strongly discourage sending order change requests by email, as the volume of emails received each day may prevent us from receiving your request in time to make an adjustment.

Cancel Orders

You may request cancellation, provided your order has not already been processed and shipped.

Payment

Cash on Delivery

Merwstore.com currently offers Cash on Delivery (COD). This payment option is available only within the United Arab Emirates.

Payment Security

These protections could be bypassed if the user’s computer is or has been infected with a virus or malicious software. Merwstore.com and its associated partners and employees cannot be held responsible in such circumstances.

Outstanding Payments

Merwstore.com reserves the right to refuse delivery or fulfilment of an order from a customer who has not paid part or all of a previous order, or with whom a legal dispute is ongoing.

Merwstore.com also reserves the right to take necessary steps, including legal action, in cases of outstanding or unpaid fees.

Invoice

The order form completed online by the customer cannot be considered an invoice.

Regardless of the purchase or payment method, the customer receives an invoice inside the parcel upon delivery.

A digital or hard copy of each invoice is recorded in the Merwstore.com database.

Security

Merwstore.com will take all reasonable precautions to ensure the security of payment details included in your order.

However, except in cases of direct negligence on our part, we cannot be held liable for losses incurred as a result of unauthorized access to information you provide.

Disputes

Good-Faith Negotiations

If any dispute, claim, controversy or difference, including any tortious or statutory claim (“Dispute”), arises out of, in connection with or in relation to this User Agreement, the parties shall first attempt to settle it amicably through good-faith negotiations.

This includes questions regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, the legal relationships established by this User Agreement, or the consequences of its nullity.

Negotiations shall take place over thirty (30) calendar days, commencing on the date one party first sends the other party written notice of the Dispute.

Arbitration

If the Dispute has not been settled amicably by the end of that period, the parties agree that it shall be referred to and finally resolved by binding arbitration under the Arbitration Rules of the Dubai International Financial Centre – London Court of International Arbitration (“LCIA”). These rules (“Rules”) are deemed incorporated by reference into this clause.

The number of arbitrators shall be one. The parties shall seek to agree on a sole arbitrator to be nominated to the LCIA Court for appointment.

If the parties fail to nominate a sole arbitrator within 30 days from the date the request is served upon the respondent, or such greater or lesser period as the LCIA Court may determine, the arbitrator shall be appointed by the LCIA Court.

The seat or legal place of arbitration shall be the Dubai International Financial Centre, Dubai, UAE.

The arbitration proceedings shall be conducted in English, and the award shall be in English.

Interim Relief

The foregoing provisions are without prejudice to the right of Awok.com to seek interim relief at any time from a court of competent jurisdiction, whether or not an arbitrator has been appointed.

Merwstore.com shall not be deemed to have breached this arbitration agreement or infringed the arbitrator’s powers by doing so.

Limitations of Liability

Maximum Liability

IN ALL CIRCUMSTANCES, MERWSTORE.COM’S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD.

MERWSTORE.COM SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING TO THE PRODUCTS IT SELLS, WHICH EXCEEDS THIS LIABILITY LIMIT.

MERWSTORE.COM SHALL NOT BE LIABLE FOR THIRD-PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY DAMAGES, WHETHER OR NOT MERWSTORE.COM HAS BEEN MADE AWARE OF THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.

Use of the Site

If you are dissatisfied with the Site or any content or materials on it, your sole exclusive remedy is to discontinue using it.

You further agree that unauthorized use of the Site and its services resulting from your negligent act or omission would cause irreparable injury to Awok.com. Merwstore.com shall treat such unauthorized use as subject to the Terms & Conditions of this User Agreement.

Discounted Products

Products deemed by the company to be super-savers or highly discounted may be subject to quantity limits per order.

The company reserves the right to alter the ordered quantity for such products or cancel the order, with or without the customer’s consent.

Order Cancellation

Merwstore.com reserves the right to cancel any unpaid order under any circumstances without liability to the customer or otherwise.

For paid orders, Merwstore.com reserves the same right, provided the amount paid is returned in full.

Governing Law

This User Agreement is governed by and construed in accordance with UAE law.

This clause will survive the expiry or cancellation of this User Agreement for any reason.

Pre-Order

Pre-order is a service that lets you order a product before its official launch date.

Delivery

We aim to deliver pre-ordered products on the official launch date, provided we have received and processed your payment. This may not always be possible due to availability at our warehouse.

Delivery charges may apply to all pre-orders unless otherwise stated.

Standard delivery timelines will apply from the moment the pre-ordered product becomes available.

We reserve the right to cancel any order for reasons we may or may not disclose. Delivery dates for pre-ordered items may change without prior notice or confirmation.

Payment

Payment must be made in advance to confirm your pre-order.

If you wish to cancel your order before shipment, you must do so at least 3 days before dispatch.
